In Russia, as you know, there are two troubles - fools and roads. Sometimes one problem takes over another, and this is how illegal parking occurs. Unfortunately, parking in large cities is in complete chaos. In Russia there are still no laws that would clearly regulate urban parking. Previously, parking lots in Moscow were run by bandits. Then the city authorities tried for a long time to come up with a way to relatively fairly charge money for parking, but in the end they never came up with anything. Today in Moscow there are practically no officially paid city parking lots. Fortunately, there are no parking attendants who used to extort money from gullible drivers. But there are a lot of illegal parking lots. In the city center, the already congested streets are taken over by restaurants, cafes, clubs, shops, even various departments and ministries occupy precious meters of the roadside for their personal parking. You've probably seen cones, ribbons, bollards and metal barriers in the city center that make it difficult to park. Most motorists simply drive by, without even thinking that the barrier can be moved away and completely legally leave your car in this place. We are with Dima Ternovsky decided to figure it out. In the following posts we will teach you how to deal with illegal parking. Our ultimate goal is to clear cities of occupied parking lots and free up the roads for ordinary motorists. In the meantime, I propose to go with us on the first fact-finding raid through the streets of Moscow.

To begin with, I suggest listening to fragments of dialogues with security and police. How do you like this format? More convenient than printed dialogues?

Meeting at the monument to Yuri Dolgoruky, right opposite the Moscow City Hall, I tried to find a place for my car. The cars are parked here in three rows, and there are telephone numbers under the windows, in case someone needs to leave. At the same time, security guards placed iron bollards at Glavmosstroy, occupying a dozen parking spaces. Without hesitation, I decide to remove the post and park my car.

The security immediately stands up for the occupiers' main weapon - a metal post. I ask the guards to show documents confirming the legality of the fences put up. They tell us that they are with the management, but everyone is busy now and cannot come to us. Of course, Glavmosstroy has no rights to such a seizure of citywide territory. The security guards talk for a long time about the fact that these are the places of their leadership; Oleg Vladimirovich Deripaska himself, the owner of Basic Element, which includes Glavmosstroy, leaves his car here. According to the security service, SUCH a person must have agreed on these places. But we have the same law for everyone. It is impossible to “agree” and take away part of the city-wide parking lot. After 5 minutes of arguing with the security, they give up and I leave my car in the place of Oleg Vladimirovich himself. First victory, you can park!

Regarding legal and illegal parking. A specific plot of land is rented for parking, but not a “piece of street”. This land plot must have a cadastral number. The lease agreement for a land plot for parking is drawn up in writing with the authorized executive body of Moscow. This parking lot must be included in the Register of City Parking Lots, which is maintained by the Department of Housing, Communal Services and Improvement of the City of Moscow. The fact that many cafe owners say that they rented a street for themselves most likely means that they rent this area for a cafe, but not for parking. Since, at the driver’s request, the parking employee must present him with a warrant confirming the fact that the parking space has been entered into the Register, the driver who is going to park near the cafe must require the employees of a particular cafe who prohibit parking to present a document of title. In case of refusal to present such a document, the driver has the right to contact law enforcement agencies. Such parking should be considered illegal; the arrangement of such parking is unauthorized occupation of a land plot, restriction of access to public land, and use of a land plot without title documents.

Next stop is the Federation Council. The parking lot is marked with a sign "vehicles of the Federation Council of the Russian Federation." Often, in legal parking lots, signs or plates are installed stating that this or that parking lot is “for employees only...”, depriving citizens of the right to park in this place. All current road signs and additional plates are indicated in a special document - GOST R 52290-2004. Any other signs (plates) are not provided for by the specified GOST. Therefore, the driver has the right to ignore such signs. I did not find in GOST that any exceptions are possible for parking only certain cars.

We park the car in the free outer space, immediately behind the sign “a\m SF RF”. An FSO officer immediately approaches and asks to remove the car. Reason - this territory is a specially protected zone and, in accordance with the law on the Federal Protective Service, they have the right to limit the presence of vehicles in such a place.

Federal Law on State Protection, Article 15, paragraph 10:
“Federal state security bodies, in order to implement state security, have the right to take, if necessary, measures to temporarily restrict or prohibit the movement of vehicles and pedestrians on streets and roads, to prevent vehicles and citizens from entering certain areas of the area and objects, as well as to tow vehicles ;"


Even though the sign itself does not comply with GOST, the requirements of the FSO officer are absolutely legal and understandable. It’s the same story with the General Prosecutor’s Office, which puts up fences along its buildings, occupying the roadway. First defeat, you can't park!

True, the Northern Fleet still discovered a violation; police officers took the places for disabled people. I am very glad that disabled people have started working in our police force. “Russia is a country of equal opportunities!”

After a hundred meters we find an excellent parking space filled with fences. We go out and move them aside. After standing for about five minutes, we still don’t wait for the vigilantes. The conclusion is obvious - if you want to park, go ahead and park!

Let's move on. Cars standing in several rows, and suddenly a couple of empty seats at the front entrance of some institution! It turned out that we took the place of the head of the Federal Agency for Press and Mass Communications. The policeman on duty on the street approaches. It turns out that the agency has no legal rights to these places, the policeman is required to drive everyone away, but he simply asks us not to park the car here.
- Can we not clean up?
- You can, but I ask you to leave.

On the one hand, I feel sorry for the police officer, but on the other hand, why don’t other car owners have such privileges? Why do ministers, heads of federal agencies and other officials take over the street for their personal parking? I am sure that when officials finally lose their privileges, when they remove the flashing lights and give up their parking spaces, then we will begin to fight traffic jams and build municipal parking lots. In the meantime, the problems of ordinary car enthusiasts do not concern them, so no one solves them.

Just around the corner is the Pushkinsky cinema. There are cars under the stairs, and fences in the empty spaces. We slow down a little, and an already unknown man cheerfully pushes aside the barriers, offering to park the car.
- How much does parking cost?
- Yes, thank me later.
- How much is “thank you”?
- Yes, if you don’t mind, then give it.
- Is 50 rubles normal?
- Yes, as much as you want.

There is a traffic police officer on the other side of the road. Whether he says the same thing as our new acquaintance is unknown. But even there there are fences and “selected” cars for parking.

And the parking attendant spends most of his time with him. By the way, this is a very good example of illegal parking. By law you can't park here at all. But this doesn’t bother the traffic police officer at all. How much do you think the cunning parking attendant gives him? How much does this traffic cop pay his boss? They organized a good business in the very center of Moscow. But we will return to these bandits in the next episodes.

Of course, these fences are also illegal. You can safely remove them and park the car. But, nevertheless, we give back the promised 50 rubles.

There are generally many such mysterious zones on Pushkinskaya. Here is one of them - who and on what basis occupied most of the sidewalk is unknown.

Driving through the center of Moscow, you can see how other traffic participants are forced to park against the backdrop of all these bollards, cones and fences. All sidewalks and lawns are covered, cars are parked in three or even four rows. And starting next year in Moscow and St. Petersburg, fines for such parking will be raised to 3,000 rubles. Thanks to our deputies and the president, who signed the law without giving citizens the opportunity to park without violations. A simple formula: “First parking, then fines!” is not clear to all government officials.

If representatives of government agencies realize that the land adjacent to their building does not belong to them, then private owners behave much more brazenly. Most often, it is impossible to explain to a thick-headed security guard that the fences placed in front of the restaurant are illegal. It is not uncommon for such parking lots to occupy the entire sidewalk or roadway. The owners of the establishments primarily care about their cars and guests, and they don’t care about the rest.

We were never able to park our car in front of one of the restaurants. The issue could have been resolved by calling the police, but we decided to do it next time.

The guard has only one argument: the director said to keep this place.

We leave and try to stand at some private club, removing one of the plastic cones. Some man explains with a strong accent that “if it’s nice,” then it’s possible. “But in general, no one here has documents for parking, it’s just that in some places there are people with machine guns, try putting them there!” Such parking attendants with their cones can be safely sent to hell.

The building of the Federal Tax Service of Russia. Columns are along the entire façade. There are no signs, parking is here for everyone, but security does not allow you to park your car. I struggled with the security guard for about five minutes over the post. Almost by force, I removed the illegal barrier and Dima parked the car. The security guard followed his superiors.

The people who came out asked for our documents and received a reasoned refusal. They talk about anti-terrorism measures, about the fact that ministers and big bosses come to visit them here non-stop, but there is absolutely nowhere to park them. “The law on electronic document management is currently being discussed, do you know what kind of people come here?!” First they threaten that the car will be towed, and then they allow you to leave it for a while. The situation is standard, officials and high authorities are more important than ordinary citizens who drive several circles around the block to find an empty seat.

Luxurious parking on Teatralny Proezd. But, alas, only representatives of the Ministry of Emergency Situations can park a car here. The story is, in general, the same as with the Prosecutor General's Office and the Federation Council. There is a sign that parking is only for emergency vehicles. Parkovskaya is completely empty, but the security complains that if anything happens, Shoigu himself will come here and there should be no slaves here so as not to embarrass the master.

The owners of Tretyakov Plaza turned out to be the most “savvy”. They simply display beautiful bicycles along the roadway. And then they park their cars and the guests’ cars in their places. The administration understands that there cannot be any parking for guests of their store on Nikolskaya Street. But in war, all means are good. From a legal point of view, it is very difficult to do anything here.

It’s more difficult to fight such grabs, but it’s still possible!

As our raid showed, you can legally park your car almost anywhere where entry is truly not restricted (checkpoint, barrier, security). All these posts, cones and chains are unauthorized seizures of citywide territory. Calmly get out of the car and move them to the side to park the car. In case of a conflict situation, call the police.

The parking situation in large cities is really difficult. In Moscow, there is often simply no way to legally leave a car in the center. Paid parking inside the Garden Ring can be counted on one hand. As a result, owners of offices, shops and restaurants in the center are forced to occupy part of the street for the cars of their clients and employees. You can fight such invaders with the help of the police. But what to do with ministries and other government agencies is not very clear. After all, it is the officials who are to blame for the fact that such a situation with traffic jams and parking has developed in Moscow. Why should a minister have dubious privileges if there is no order in the city and country? If they cannot provide citizens with accessible parking, let them move all their departments outside the Moscow Ring Road and park where they want. Moscow is already too crowded.

Some of the guards are threatening to evacuate. Remember that threats to tow a car are just an attempt to scare the car owner. I called several towing services, including the state one, where they refused to help me move other people's cars from the restaurant parking lot. They have no right to move other people's cars. This is only possible in the presence of a traffic police officer who has grounds for doing so. So rest assured, NOBODY will tow your car if it is parked according to all the rules. Another part of the parking lot invaders threaten to puncture the tires or scratch the car. It is unlikely that anyone will risk carrying out the threats, but just in case, if you feel a controversial situation, turn on the camera on your phone and tell the security that all his threats are recorded and in the event of damage to your property, he will be the first to be suspected. Also, please note to the security that you have a company car and it is insured, and if something happens, he will not deal with you, but with the lawyers of your employer and the insurance company. In my practice, these measures are enough to cool the ardor of any presumptuous guard.

1. What to do if a parking attendant or a person without a badge is impeding parking by blocking traffic with a cone or post (how to behave on the spot, and where to call, as well as where to complain later).

You can distinguish a legal parking attendant from an illegal one by a reflective vest, on which the current tariff is indicated, and a special badge with an individual number. In addition, official parking attendants, upon the first request of the driver, must present permits for the operation of the parking lot (color copy of the order with a hologram) and an employee identification card.

If you are randomly denied parking, refuse to explain the reasons and present a legal act establishing such a ban, feel free to call number 02, or the duty station of the relevant police department. Tell the officer on duty where you are, state the problem, and ask to send a police officer to eliminate illegal obstacles to your rights.

With the support of the Moscow City Internal Affairs Directorate, Stolichnye Parking LLC has set up a hotline (998-85-05) where drivers can complain about illegal activities of parking attendants or violations of parking rules.

2. A separate topic - is this parking on the sidewalk or on the roadway, is there a difference?

You can park temporarily in accordance with traffic regulations and on the roadway. But the administration’s requirement not to park cars on the roadway next to hotels, restaurants or clubs is often illegal. The only thing that can prohibit parking on a public roadway is the corresponding road signs or markings.

Parking on sidewalks is not permitted. But it can be equipped in areas directly adjacent to the road and not intended for through traffic of vehicles (yards, residential areas, etc.).

Legal parking is indicated by appropriate signs and markings, has a hard surface, lighting, fire-fighting equipment, special places for the entry and exit of vehicles, and special places for disabled vehicles. It is not allowed to equip parking lots with structures, in particular, fences, that are not provided for by the relevant GOST.

All city parking lots in Moscow (paid, service, free) are included in the Register of City Parking Lots. The fact that a parking space is included in the Register is confirmed by the issuance of a warrant. This Register is maintained by the Department of Housing, Communal Services and Improvement of the City of Moscow. When transferring a city parking lot into operation, the order is drawn up in triplicate. The first is stored in the Department of Housing, Communal Services and Improvement of Moscow, the second is sent to the State Unitary Enterprise "City Paid Parking Service", the third is transferred to the operator (Moscow Government Decree of November 1, 2005 No. 854-PP).

3. Is it important whether such parking “for our own” is organized near a private territory (restaurant, club, bank) or a state company or department (Glavmosstroy, Ministry of Emergency Situations, Tax Service).

Often, in legal parking lots, signs or plates are installed stating that this or that parking lot is “for employees only...”, depriving citizens of the right to park in this place. All current road signs and additional plates are indicated in a special document - GOST R 52290-2004 “Technical means of organizing traffic. Road signs. General technical requirements". Any other signs (plates) are not provided for by the specified GOST. Therefore, the driver has the right to ignore such signs. In the event of a trial, the driver will be able to prove that the additional sign is not provided for by GOST and that the traffic rules have not been violated. At the same time, a photo or video image of such inappropriate signs should be provided.

City service parking is a parking lot transferred for use to legal entities and intended to accommodate official and/or guest vehicles, organized by the State Unitary Enterprise of Moscow "City Paid Parking Service" and issued with lease agreements for the State Unitary Enterprise "City Paid Parking Service"

Thus, all parking lots that are not included in the specified Register (or, in the case of official parking, are not documented in a lease agreement with the State Unitary Enterprise “City Paid Parking Service”) are illegal. Arranging such a parking lot means unauthorized occupation of a land plot, restriction of access to public land, and use of a land plot without title documents. Responsibility for such actions is provided for by the Moscow City Code on Administrative Offenses (installation of fences or blocking of roadways with them without permission issued by a body authorized by the Moscow Government entails the imposition of an administrative fine).

4. Is it possible to do something about the smart guys who display bicycles, taking up all the places on purpose?

If parking a bicycle in a given place is not prohibited by traffic regulations, then it will not be easy to convict those who specifically display bicycles to occupy parking spaces. They don't formally violate anything. But you shouldn’t remove the bike yourself; you may be accused of trespassing on someone else’s property. It might make sense to make video recordings of this kind of dubious manipulation of bicycles by the administration of such establishments, and then send these recordings with the appropriate statements to the competent state and municipal services. In such actions, at least, there is a reason for the authorities to issue an official order to them.

And by the end of the year it will come to more than 200 streets in residential areas for the first time. Two unpopular steps by the Moscow authorities gave rise to another, quite predictable wave of discontent.

A coalition has been created in Moscow that aims to cancel the expansion of paid parking outside the city center and to achieve a review of the decision-making mechanism regarding new parking zones. It included the Moscow City Committee of the Communist Party of the Russian Federation, the Moscow Motorists movement, the Blue Buckets community, the Center for Economic and Political Reforms, as well as municipal deputies of some districts of the city. At the first meeting of the association, the “Memorandum of the Open Coalition in Defense of the Constitutional Rights of Moscow Residents” was distributed.

“We, residents of the city of Moscow, representatives of initiative groups of citizens, public and political organizations, municipal deputies, deputies of the Moscow City Duma and deputies of the State Duma, believe that the activities of the Moscow government regarding the organization of paid parking and the implemented policies in the transport sector lead to a violation of constitutional rights of citizens and provokes an increase in social tension in society. The policy pursued by the Moscow government in the transport sector has led to an increase in social stratification in society and to the fact that the majority of Moscow residents find themselves left out of a decent life. There is no dialogue on this issue between the Moscow government and city residents,” the document says.

The demands of the new association boil down to three points, which have been separately voiced several times over the past two years: the cancellation of the decision to expand the paid parking zone in residential areas of the city, the resignation of the head of the Moscow Department of Transport, Deputy Mayor Maxim Liksutov, and the transfer of powers to introduce paid parking in certain areas to municipal deputies and residents.

The coalition also proposes to revise the mechanism for approving and introducing new parking zones. It is proposed to create a public commission in each district, 80% of whose composition will be provided by local residents, and the remaining 20% ​​by municipal deputies. Now decisions on paid parking are made by city authorities, and the opinions of residents and deputies are taken into account only “on paper.” At the same time, the Department of Transport claims that they are not aware of any cases of complaints about this procedure and the facts of demands to cancel the already launched paid parking lots.

“We will hold rallies until the end of the year, and it is unlikely that any new formats will appear. But next year, I think, we will try to hold a citywide referendum. It is very important to understand that we do not want to make a decision about the need or unnecessaryness of paid parking in certain areas. And we're not saying that we have a better understanding of the problem than the Department of Transportation. We want this issue to be resolved not by separately appointed officials, but by the city residents themselves, who are directly affected by all this. And if people in some area, even beyond the Moscow Ring Road, want to have such a paid zone, then no one is against it. It’s not a matter of paid parking itself, but a decision-making mechanism,” one of the coalition participants, coordinator of the Blue Buckets society Pyotr Shkumatov explained to gazeta.ru.

Also, State Duma deputies believe that President Vladimir Putin is misinformed regarding how the paid parking system works in Moscow. The parliamentarians were prompted to such thoughts by the speech of the head of state, in which theses that did not correspond to reality were heard from his lips.

“The Moscow authorities decided that these parking lots and their prices are set not simply by instructions from the Moscow mayor’s office, but in agreement with the municipality and the district. Moreover, deputies in the districts have the right to make decisions on this issue. And citizens who live in nearby areas use parking for free. I repeat, this is also left to the decision of local municipalities. Revenue from parking goes 100% to the revenue side of local district budgets,” Putin said.

However, in fact, municipal deputies are deprived of the opportunity to influence the decisions of city authorities. Local residents can park for free only from 20.00 to 08.00, and a 24-hour subscription costs 3,000 rubles per year. In addition, permits cannot be obtained by those who rent an apartment or drive a company car: to obtain it, you must have registration, and the car must be registered in the name of the tenant registered in the apartment.

“The information was distorted, and now we are preparing a letter so that Putin can figure out who is misleading him. We will also attach Liksutov’s personal order on the introduction of paid parking. It doesn't even have the mayor's signature. We will provide the president with truthful information, because if he does not know what is happening, we need to show him all the materials. In addition, we will send a bill that we have already developed and sent for consideration to the State Duma, but United Russia is not allowing it to be considered. And then the president will be right: decisions on paid parking will be introduced only with the permission of deputies and the population,” said deputy from the Communist Party of the Russian Federation Valery Rashkin.

United Russia member Vyacheslav Lysakov is planning to address the same questions to the presidential administration. It is not yet clear who will emerge victorious from this fight. However, as confirmation of the rightness of the dissatisfied, further evidence from municipal deputies has already appeared that the expansion of the paid parking zone in residential areas planned for December 26 did not take into account the opinion of the public.

IGOR IZMAILOV: Don’t you think that closing the numbers is the position of people who are thus telling the capital’s authorities that they do not agree with the tariffs that are being offered to them or with the approach to resolving this issue? There is the same position among people who do not pay for anything in principle.

VADIM MELNIKOV: In my opinion, there are much more effective, civilized ways of saying that you are against it.

V.M.: Starting with various portals and information resources.

V.M.: There is communication with prefects and so on. There is an opportunity to write letters, there is the possibility of collective appeals.This is a civilized way of communicating with authorities.

From the point of view of using such methods to bypass registration, those who are willing to pay for parking and those who act within the framework of the law suffer, among other things. When approaching a place, they cannot take advantage of the opportunity that is given to them.

I.I.: The place is occupied - what's the problem?

V.M.: Only in this case there are people who put themselves above and do not pay for parking using some methods. And those people who comply with the requirements of the law and are ready to pay the tariff do not physically have this opportunity, since the space is occupied by those people who, in fact, do not want to do this.

I.I.: When the Porsche guys come and park their cars, they are outraged because they have nowhere to park their car, but these guys are parked here and don’t even pay. What difference does it make: they pay or not?

I.I.: Don’t you think that this is the position of people who in this way tell the capital’s authorities that they do not agree with the tariffs that are being offered to them, or with the approach to resolving this issue? There is some order, but the difference in the scales of these positions remains. How can the two sides agree?

V.M.: Once again, I would like to draw attention to the fact that the position that is voiced in the form of the action of removing license plates and then covering them with something does not concern the relationship between the authorities and the people who allow themselves to do this, but namely between different groups of motorists. Agree, most people adequately use the parking space, pay for it, and this is not a problem for them: they use this service as an opportunity to park their car and then go about their business. Those people who put themselves above everyone else, for some reason...

I.I.: Why higher? I drive up: there are different cars in the parking lot, some of them without license plates, I’m not offended by them even once, they write: the place is occupied. What difference does it make to me whether he paid or not?

V.M.: But if you can't find a free space, do you have to look for places to park?
